Nassau County Ensures Compliance with Amended Federal E-Discovery Rules using Clearwell

One of New York’s Largest Counties Deploys Clearwell In Response To Complex FRCP Changes Regarding Preservation and Retrieval of Electronically Stored Information

SANTA CLARA, Calif.—February 12, 2007—Clearwell Systems, Inc., a pioneer in Email Intelligence, today announced that the attorney’s office for Nassau County, one of the largest counties in New York state, has deployed the Clearwell Intelligence Platform® to ensure compliance with the recent amendments to the Federal Rules of Civil Procedure (FRCP) regarding electronic discovery. In addition, Clearwell’s intelligent analysis capabilities enable Nassau County to perform faster early case assessments and develop better case strategies.

The amendments to the FRCP rules 16, 26, 34 and 37, which were approved by the U.S. Supreme Court and took effect on December 1, 2006, require anyone who can be involved in litigation in federal court to retain electronic records – such as emails, instant messages and text documents – and be able to retrieve them. The rules also require all parties to present a description of all electronically stored information within 99 days of the beginning of a legal case. Failure to comply with these rules within the specified deadlines can result in fines by District Court judges.
