Restores from NDMP based backups of filers fail when done from backup sets made after incremental backups containing no changes

Problem
Restores from NDMP based backups of filers fail when done from backup sets made after incremental backups containing no changes.
Example:
Run NDMP based full backup of a filer.
Run incremental level 1 with file changes.
Run incremental level 2 with no file changes.
Run incremental level 3 with file changes.
Run restore selecting all files listed in set from Incremental level 3
Restore fails without restoring files backed up from incremental level 3 with error mentioned below:
Error
Final error: 0xe000130a - The NDMP server returned a restore error.

A selection on device //Filer:10000/test was skipped because of previous errors with the job.
Solution
Workaround:
Individually select files for restore from the problem incremental backup set (issue comes up only for folder level selection).
