End-Of-Life, End-of-Availability and End-of-Support Announcement for Certain Clearwell eDiscovery Hardware

Solution

Effective February 1, 2012, Symantec is announcing the End of Life (EOL) for the Clearwell hardware equipment listed below (“Hardware”).  No new orders will be taken for the Hardware after March 1, 2012 (the “End of Availability”/”End of Sales” date).  Symantec has begun selling and shipping the next generation Clearwell eDiscovery platform, leveraging the Dell PowerEdge R810 equipment, which provides the same functionality as the Hardware along with greater I/O capabilities and scalable storage to help address customer requirements.

It is important to note that this EOL announcement applies to the Hardware only and does not impact any software included in the Clearwell product suite.

Customers with current Clearwell/Symantec support/maintenance agreements will continue to receive technical support for the Hardware for a period ending the earlier of: (i) the expiration of the Customer’s then-current support/maintenance agreement; or (ii) End of Support date noted below for the applicable Hardware.  All technical support during this period will be provided in accordance with the terms of the relevant support/maintenance agreement, subject to the support lifecycle provisions described below and in the applicable agreement.

Support Life Cycle

Symantec provides different types of Appliance Support deliverables, depending on where the Appliance is in its lifecycle, as described below. The Appliance lifecycle starts when it is added to the Symantec price list and becomes commercially generally available for purchase. It reaches its End of Life when Symantec removes it from our price list and ceases marketing or distributing the product. The End of Life date starts the timeline and processes leading to End of Support for that product, at which point Symantec will cease to provide all technical support for the product, regardless of the nature of the Customer’s problem.

Hardware Support after End of Life Announcement: After the End of Life Announcement and prior to the End of Support Life date, Symantec will support the Hardware  in accordance with the terms of the relevant support/maintenance agreement. Symantec will honor all existing contracts throughout this period, provided, however, that in the event that a vendor to Symantec of any of the Hardware or Hardware components ceases to provide support services for such Hardware or Hardware components, or ceases to offer related support renewals to Symantec prior to the date Symantec announces for End of Support for the Hardware, then Symantec may elect to change the End of Support date and accelerate it, and in which the case the Customer will need to migrate to a current version of the hardware to be eligible for support services.

End of Support Life (Obsolete):  When the Hardware reaches its End of Support, we will cease providing any hardware support.  Please refer to the applicable Appliance support services policy for further details.  In the event of conflict between timelines or deliverables stated in this EOL announcement and those stated in the applicable policy, the terms of this EOL announcement will control to the extent of such conflict, and only with respect to the specific products and versions covered in this EOL announcement.
