1) Does a CFS node perform fsck on already cfsmounted vxfs when it's cluster peer reboots due to panic?
The answer is yes fsck will take place when node transitions from secondary to primary.

2) Can veritas run fsck while Database is up and running on 02 ?
Yes, please see answer to #1. However fsck cannot run from command line from user-land:
Here is an example from a lab system which answers the above questions:
