Hi,

How can a DLP policy be created to exclude detection and monitoring of emails marked as private in Outlook?

When you mark an email as

When you mark an email as "private" in Outlook, it adds a header tag to the email like this:

Thread-Index: Acy05aTVDkCD6kYISguv+c6g7I1NDQ==
Sensitivity: private
Date: Wed, 7 Dec 2011 13:39:44 +0000
Message-ID: <32C0DE9C482A3A42810C293FB9E308405AEE3D@SN2PRD0702MB114.namprd07.prod.outlook.com>
Accept-Language: en-US

So...you should be able to do an exception that looks only at the email header, for the keyword "Sensitivity: private".  But, just realize here that you're giving any user the ability to circumvent email inspection simply by marking a message as "private", which is a huge hole.
