GRT on VM: Remote Agent on Windows VM covered by VMware License?

I Use "Agent for VMware Virtual Infrastructure" to Backup VMs in BackupExec 2010 R2 

 

When I Back up a Win2K8-R2 VM, the Backup fails

When I Back up a Win2K8 VM, the Backup finisches successfully but am not able to restore individual Files (GRT)

When I Back up a Win2K3 VM, the Backup finisches successfully and am can restore individual Files as well as the hole VM.

 

I have fond a Workaround:

When I install Remote Agent for Microsoft Servers on the 2K8 and 2K8R2 VMs, the Backup finisches successfully.

 

So far so good. But what about licensing? I own only Remote Agent Licenses for the physical Windows Servers. Is it covered with the "Agent for VMware Virtual Infrastructure" License to install "Remote Agents for Windows Servers" on all VMs?

You are allowed the install the Remote Agent for this purpose inside a VM as part of the AVVI licenese - this is unlimited as long as AVVI is licensed correctly for each ESX host
