    I recently got this second hand laptop, bought from a cash-converter, that has this said encrpytion.

    How do I reformat this? I don't have the password and have no way to recovery it.

    The laptop is a HP EliteBook 820, i5 with Windows 7.

    You should be able to use Windows installation media (e.g. Windows 7 DVD), boot from that, and reinstall Windows.  If not, you should be able to use it to get into the Advanced Recovey (command line), and type:
    bootrec /fixmbr

    That should clear out the boot sector, and allow you to continue reinstalling Windows.
