While creating a backup job within Backup Exec 2012, specifying an exclusion rule that uses the, 'File not access in,' X days, where X is the number of days a file has since been last access excludes all files of specified type. This was not an issue in previous versions.

I'm up to date on 2012, sp1 with 5 hotfixes as of 02/14/2013.

This is still an issue. Also if you have a large selection list and add an exclusion of not accessed in X number of days it'll delete the selection list.
