OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN

1.    DESCRIPTION OF CONTESTS   

The Veritas Operations Manager (“VOM”) or Veritas Operations Manager Advanced (“VOMA”) Contests are designed to encourage IT and system professionals to write blogs and create videos to share their experiences regarding their use and application of VOM and VOMA in their IT environments.  The VOM Tell Your Story Contests 2012 comprises of two contests involving: (1) writing and posting of a blog regarding the use of VOM or VOMA and (2) writing and posting a blog as well as creating and posting a video regarding the use of VOM or VOMA (the “Contest” or “Contests”).  One grand prize will be awarded for the best blog, and one grand prize and one runner-up prize will be awarded for the best and second best video/blog, as determined by qualified judges in accordance with these Official Rules.  Additional prizes in the form of Symantec Connect Points will be awarded to all bona fide Entries into the Contests.

2.  SPONSOR

The Contests are sponsored by Symantec Corporation at 350 Ellis St., Mountain View, California, 94043, U.S.A. (the “Sponsor”).

3.  ELIGIBILITY – VOID WHERE PROHIBITED

The Contests are open to persons who are legal residents of one of the 50 United States, the District of Columbia (excluding Guam, Puerto Rico, and all other U.S. territories and possessions), or Canada (excluding the province of Quebec).  Void in Guam, Puerto Rico, the province of Quebec, and where prohibited by law.  Entrants must have reached the age of majority in their state or province of residence at the time of entering the Contests in order to participate. Persons in any of the following categories are NOT eligible to enter, participate in, or win the Contests: (a) persons who on or after Monday, December 17, 2012 at 12:01 a.m. Pacific Time were or are officers, directors or employees of Symantec Corporation or any of their respective parent, subsidiary, or affiliated companies, or service agencies, or independent contractors of any of the above organizations; (b) individuals engaged in the development, production or distribution of materials for the Contests; and (c) persons who are immediate family members (defined as spouse or biological or step- mother, father, sister, brother, daughter, or son and each of their respective spouses) of any person in any of the preceding categories, regardless of where they live, and/or individuals who reside in the same household, whether related or not, as any person in any of the preceding categories. Any questions or issues concerning eligibility shall be determined at the sole discretion of the Sponsor. 

4.  HOW TO ENTER

The Contests begin on August 8, 2012 at 12:01 a.m. Pacific Time and ends on December 16, 2012 at 11:59 p.m. Pacific Time (the “Contests Period”).  You can enter the Contests by: (1) visiting the Symantec Connect website under the Storage and Clustering Community at http://www.symantec.com/connect/groups/vom-tell-your-story-contest-2012 (the “Contests Website”), (2) joining the “VOM Tell Your Story Contest 2012” subgroup during the Contests Period, and (3) following the posted instructions on the Contests Website.  All entries after December 17, 2012 at 12:01 a.m. Pacific Time are ineligible and disqualified.  Sponsor’s clock is the official time clock of the Contests.  Proof of submission does not constitute proof of receipt.  Participants may submit multiple entries to the Contests, but an Entrant cannot win more than one grand prize, and each entry must meet the Submission Requirements in Section 4 below and these Official Rules.  Entrants are required to agree to these Official Rules at the time of entry by using the accept feature at the Contests Website.  All Entries must be in English.

5.  SUBMISSION REQUIREMENTS

Your entry (“Entry” or “Entries”) must meet all of the following requirements for submission and eligibility into the Contests:

A.  Contest A – Blogging

  • Entrant must join the “VOM Tell Your Story Contest 2012” subgroup under the Storage and Cluster Community at the Symantec Connect website : http://www.symantec.com/connect/groups/vom-tell-your-story-contest-2012
  • Entrant must write a blog post of at least 200 words as well as answer the following questions in Entrant’s blog:
    • Identify your role in your organization (e.g., CTO, CIO, Director, System Administrator, etc.).
    • Identify your system concerns or issues and explain how VOM or VOMA helped solve the problems.
    • Explain why VOM or VOMA is the right choice for you or your organization.
    • Explain how VOM or VOMA has helped contribute to your success.
  • Entrant must tag his or her blog entry with “VOM Tell Your Story Contests 2012.”
  • All entries must be submitted by December 16, 2012 at 11:59 p.m. Pacific Time.

B.  Contest B – Video plus Blog

  • All the same submission requirements in Contest A apply in Contest B, with additional submission requirements for the video component of Contest B.
  • Entrant must join the “VOMTell Your Story Contest 2012” subgroup under the Storage and Cluster Community at the Symantec Connect website: http://www.symantec.com/connect/groups/vom-tell-your-story-contest-2012
  • Entrant must write a blog post of at least 200 words as well as answer the following questions in Entrant’s blog:
    • Identify your role in your organization (e.g., CTO, CIO, Director, System Administrator, etc.).
    • Identify your system concerns or issues and explain how VOM or VOMA helped solve the problems.
    • Explain why VOM or VOMA is the right choice for you or your organization.
    • Explain how VOM or VOMA has helped contribute to your success. 
  • Entrant must tag the blog entry with “VOM Tell Your Story Contest 2012.”
  • Entrant’s video must be at least one (1) minute in duration solely featuring and displaying VOM or the VOMA console in the video with Entrant’s voiceover communicating the IT problem(s) and identifying the specific VOM or VOMA functionalities or features that helped solve such problem(s) in one or more of the following subject categories:
    • Avoiding Errors (e.g., misalignment between application tier and storage characteristics, void depletion of storage by reviewing forecast reports and monitoring thin pools, etc.)
    • Saving Time (e.g., provision storage, using rule based business views, etc.)
    • Saving Money (e.g., create chargeback report identifying offenders, find hosts with unused LUNs, arrays with unallocated storage, zombie VMs, unused aggregates, etc.)
    • Innovative Usage (e.g., custom scripts, reports, or health checks, use of xdisk to execute commands on a hots, use deployment manager to distribute patches, export csv data tying back to your data center, etc.)
  • The video Entry must be uploaded on the Contests Website, tagged with “VOM Tell Your Story Contest 2012,” and linked to Entrant’s applicable blog post. A video not linked to Entrant’s blog will be disqualified or ineligible for the Contest.
  • All Entries must be submitted by December 16, 2012 at 11:59 p.m. Pacific Time.

Your Entry must further comply with all of the following requirements:

  • Your Entry must not violate any right of a third party including, without limitation, any copyright, trademark, patent, trade secret, confidentiality, publicity, privacy, and any other intellectual property right.  Your Entry and participation in the Contests are subject to the Terms of Use of the Symantec Connect community website at https://www-secure.symantec.com/connect/legal, which are part of the Official Rules and incorporated herein by reference. 
  • Your Entry must not contain any names or logos of any companies or products of a third party other than the Sponsor, and must not contain any personally identifiable information of any person, including appearance, voice, or likeness of any person, other than yourself. 
  • Your Entry must be your original work of authorship, sole property, unpublished, and not previously submitted in any other contest.  You Entry must not incorporate music that is not wholly owned or created by you and  
  • Your Entry must not include any content or material that depicts or incorporates unsafe behavior or situations, obscenity, defamation, disparagement of any product, person, or organization, or any other inappropriate or objectionable content or material, as determined in the sole discretion by the Judges and/or Sponsor. 
  • By submitting an Entry, you agree that Sponsor has the unrestricted right and non-exclusive license to use your Entry in whole or in part, commercially or non-commercially, in any media known or unknown, in perpetuity, worldwide, including the right to publish, display, copy, distribute, and sublicense the Entry for advertising and publicity purposes, and to edit, modify, and make derivative works thereof, all without additional review by or compensation to you.  As a condition of Entry, you agree that Sponsor may post your Entry (including your name and/or likeness) on its website(s), web pages of third party sites, and other publications for advertising and promotional purpose without review by or compensation to you.
  • To submit your Entry, you must read and agree to these Official Rules. You agree that by submitting your Entry, you relinquish all rights with respect to your Entry, its content and materials thereof, as outlined herein, and the Entry becomes the property of the Sponsor and will not be returned. 
  • The Judges and/or Sponsor reserve the right to disqualify at any time any Entry that they determine in their sole discretion that does not comply with these Official Rules.

6.  WINNER SELECTION & JUDGING

  • All bona fide blogging Entries submitted during the Contests Period will be awarded 100 Symantec Connect points, which points are redeemable through the Symantec Connect Rewards program at: https://www.symantec.com/connect/rewards.
  • All bona fide video plus blog Entries submitted during the Contests Period will be awarded 200 Symantec Connect points, which are redeemable through the Symantec Connect Rewards program at: https://www.symantec.com/connect/rewards.
  • Any video without a corresponding blog will not be awarded any Symantec Connect points under the Contests.
  • All Entries will be automatically entered into the Evaluation Round where Entries will be reviewed by our qualified judges for a chance to win the following prizes:
    • Contest A – Blogging
      Grand prize winner will receive 1,000 Symantec Connect points.
    • Contest B – Video plus Blog
      Grand prize winner will receive USD $2,000 in the form of an American Express gift card or a check as determined by Sponsor.
      First runner-up winner will receive USD $1,000 in the form of an American Express gift card or a check as determined by Sponsor.  

    All Entries will be judged by a panel of experts with working knowledge of VOM and VOMA.  All Entries are evaluated and weighted according to the following judging criteria:

    • Contest A – Blogging
      (i)    Writing Quality – 30%
      (ii)   Technical Merit/Detailed Use of VOM or VOMA – 40%
      (iii)   Originality/Creativity – 30%
      In the event of a tie, the participant among the tied Entries with the highest score in (ii) Technical Merit/Detailed Use of VOM or VOMA will be declared the winner in Contest A.
    • Contest B – Video plus Blog
    • (i)    Writing Quality – 20%
      (ii)   Execution of Video – 20%
      (iii)  Technical Merit/Detailed Use of VOM or VOMA in Blog – 30%
      (iv) Technical Merit/Detailed Use of VOM or VOMA in Video – 30%

    In the event of a tie, the participant among the tied Entries with the highest score in (iv) Technical Merit/Detailed Use of VOM or VOMA in Video will be declared the winner in Contest B.

    Winners will be selected on or about December 21, 2012, by the judges.  All decisions of the judges are final and binding.  Winners will be notified by telephone and/or email using the contact information provided at the time of entry.  Sponsor will make two attempts to contact the winner. If Sponsor is unable to contact a potential winner, the corresponding Entry may be deemed ineligible to win a prize and the next highest scoring Entry may be chosen. In addition, if Sponsor elects, it may announce the winner on the Contests Website.  Sponsor shall have no liability for any winner notification that is lost, intercepted, or not received by the potential winner for any reason.  In the event of a dispute as to the identity of an Entrant, the affected Entry will be deemed submitted by the authorized account holder of the email account associated with the corresponding Symantec Connect posting for the Contests.  A potential winner may be required to provide Sponsor with proof that the he or she is the authorized account holder of the email account associated with the submitted Entry.  If a dispute cannot be resolved to Sponsor's satisfaction, the affected Entry will be deemed ineligible to win a prize, but these Official Rules will otherwise continue to govern the affected Entry.  In the event a potential winner or winner’s employer has a policy that prohibits the awarding of a prize to an employee, the prize will be forfeited and an alternate winner may be selected.  If the potential winner is a Canadian resident, then he or she must answer correctly without assistance a time limited mathematical skills testing question before being awarded any prize.

    7.  PRIZES / APPROXIMATE RETAIL VALUE

    The total estimated monetary value of all the prizes to be awarded under the Contests is approximately USD $3,500.  Prizes are not transferable, exchangeable, and with Symantec Connect points, not redeemable for cash, and the prizes must be accepted as awarded with no substitutions of any kind except by the Sponsor, who reserves the right to substitute a prize of comparable or greater value at its sole discretion.

    Winners shall be solely responsible for any required federal, state, provincial and/or local taxes, sales tax, surcharges, service charges, delivery, processing and handling fees, and all other costs incurred in claiming the prize.  Where applicable, winners will be issued a 1099 Tax Form following the receipt of prize for the retail value of the prize. If required by law, Sponsor reserves the right to withhold and remit to the appropriate taxing authorities the amount of any tax or taxes due.  With respect to non-cash prizes, it may be legally necessary (as determined by Sponsor in its sole discretion) for the prize winner to pay the amount of any tax before receiving the prize.  Any other costs and expenses incurred with the submission of an Entry or acceptance of the prize are the Entrant’s sole responsibility.  All details and other restrictions of prizes not specified in these Official Rules will be determined by Sponsor in its sole discretion.

    Winners will be required to sign and return affidavits of compliance and eligibility, a liability release, and where lawful, a publicity release (collectively, "Prize Claim Documents") within 15 calendar days of notification, or the winner’s prize may be forfeited and the next highest scoring Entry may be selected as the winner.  If any prize notification email, letter, or prize is returned as undeliverable, winner may be disqualified and the next highest scoring Entry may be selected as the winner.  Confirmation of prize winner is subject to Sponsor's verification of the Prize Claim Documents.

    Sponsor cannot accurately predict the number of Entries in the Contests and therefore reserves the right, in addition to those other rights reserved herein, to modify any date(s) or deadline(s) set forth in these Official Rules or terminate the Contests and not award all of the Prizes due to the insufficient number of Entries for the Contests, which actions are within Sponsor’s sole discretion.

     8.  DATA PRIVACY

    All Entrants agree that personal data, especially name and address, may be processed, stored, and otherwise used for the purposes and within the context of the Contests and any other purposes outlined in these Official Rules.  Entrants further agree that the data may also be used by the Sponsor in order to check entrants’ identities, emails, postal addresses, telephone numbers, or to otherwise verify the eligibility to participate in the Contests.  If reasonably feasible, Entrants may ask to access any personal data held about them by the Sponsor by writing to the Sponsor at the address listed above.  If an Entrant’s personal data is not provided to Sponsor, Entrant’s Entry will be deemed ineligible for the Contests. 

    9.  RELEASE

    AS AN ENTRANT IN THE CONTESTS, YOU AGREE THAT THE SPONSOR AND ITS SUBSIDIARIES, AGENTS, DIRECTORS, OFFICERS, EMPLOYEES, REPRESENTATIVES, AND ASSIGNS (THE “RELEASED PARTIES”) (A) SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY LOSSES, DAMAGES, OR INJURIES OF ANY KIND WHATSOEVER RESULTING FROM YOUR PARTICIPATION IN THE CONTESTS OR ANY CONTEST-RELATED ACTIVITY, OR FROM YOUR ACCEPTANCE, RECEIPT, POSSESSION AND/OR USE OR MISUSE OF THE PRIZE(S), AND (B) HAVE NOT MADE ANY WARRANTY, REPRESENTATION, OR GUARANTEE EXPRESS OR IMPLIED, IN FACT OR IN LAW, WITH RESPECT TO THE CONTESTS OR PRIZES, INCLUDING, WITHOUT LIMITATION, TO SUCH PRIZE’S QUALITY OR FITNESS FOR A PARTICULAR PURPOSE. 

    10.  LIMITATION OF LIABILITY

    The Released Parties assumes no responsibility for any damage to your computer system, which is occasioned by accessing the Contests Website or participating in the Contests, or for any computer system, phone line, hardware, software, or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature.  Without limiting the generality of the foregoing, Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen, or postage-due submissions, Entries, or prize notifications; or for lost, interrupted, inaccessible, or unavailable networks, servers, satellites, Internet Service Providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone, or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information.  Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Contests or the Contests Website, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Contest, or to annoy, abuse, threaten, or harass any other Entrant or Sponsor, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. 

    11.  INDEMNITY

    To the maximum extent permitted by law, by submitting an Entry for the Contest, Entrant agrees to indemnify the Released Parties from any liability, claim, demand, loss, damage, cost, and expenses arising from Entrant’s non-compliance with the Official Rules for which Sponsor will or may become liable, including violation of third party rights, including without limitation, intellectual property, confidentiality, privacy, and other rights.

    12.  FORCE MAJEURE

    In the event Sponsor is prevented from awarding prize(s) or continuing with the Contests as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal, state, or local government law, order, or regulation, public health crisis (e.g. SARS), order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), then subject to any governmental approval which may be required, Sponsor shall have the right to modify, suspend, or terminate the Contests.  If the Contests are terminated for Force Majeure before the designated end date, Sponsor may (if possible) select the winner(s) from all eligible, non-suspect Entries received as of the date of the event giving rise to the termination.   

    13.  SEVERABILITY

    The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision.  In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

    14.  CHOICE OF LAW

    All issues or questions regarding the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the Entrants and Sponsor in connection with the Contests, shall be governed by, and construed in accordance with, the laws of the State of California without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than the State of California.  Participants agree that any demand, dispute, claim, or cause of action relating to the Contests shall be resolved individually without resort to any form of class action, and hereby consent to the jurisdiction and venue residing exclusively within the federal or state courts located in Santa Clara County, California, USA. 

    15.  WINNER

     Check the Contests Website after December 21, 2012 to find out the grand prize winners and the runner-up winner.
