Terms & Conditions

Once You reserve space on a Symantec Non-Web Based Training Course, Symantec will hold Your reservation(s) for a period of 48 hours. Payment for all reserved Non-Web Based Training Courses is due prior to the expiration of this 48 hour period. Unfortunately, due to course scheduling constraints, reservations for which payment is not received within such 48 hour period will be canceled without notice.

If for any reason You wish to cancel or reschedule a Non-Web Based Training Course for which You have already paid Symantec, Your request to cancel or reschedule must be received by Symantec at least ten (10) business days prior to the start date for the scheduled Non-Web Based Training Course for which You registered. For cancellation or rescheduling requests received less than ten (10) business days prior to the start date for the scheduled non-web based training course, no refund will be granted and all fees attributable to such Non-Web Based Training Courses will be due in full. There are no cancellation or refunds for Training Bundles or components purchased as a part of a Training Bundle.

In the event Symantec cancels or reschedules a Non-Web Based Training Course, You will be notified of such cancellation or rescheduling by Symantec. Once notified You may request a refund or You may reschedule Your attendance in accordance with Symantec’s standard policies in effect at the time. In no event will Symantec be liable for any travel and living costs and expenses in the event of a Non-Web Based Training Course cancellation or rescheduling. Training Bundles are non-refundable.

If You request a change in your original course election, Symantec will make reasonable efforts to accommodate a requested change in course election provided such written request is received at least ten (10) business days prior to the originally scheduled course start date. Under no circumstances will Symantec be liable to You if Symantec is unable to accommodate Your requested change in course election.

You agree not to export or re-export any of the Course Materials in violation of U.S. export laws and regulations.

No cancellations or refunds will be permitted for Web Based Training Courses once activated.

This Symantec eLibrary subscription Certificate ("Certificate") is a legal agreement between the individual or organization ("You" or "Your") named on the face of this Certificate, and Symantec Corporation and/or its subsidiaries ("Symantec"). This Certificate states the terms and conditions under which Symantec grants You access to and use of Symantec’s eLibrary, as further described below. By subscribing to Symantec’s eLibrary, you acknowledge and agree that Your access to and use of Symantec’s eLibrary is subject to the terms contained in this Certificate and Symantec's then current eLibrary Policy located at http://eval.symantec.com/downloads/edu/SES_EULA_TC.pdf.

IF YOU DO NOT AGREE TO THESE TERMS, THEN YOU ARE NOT ELIGIBLE TO ACCESS AND / OR USE SYMANTEC’S eLIBRARY. ACCESS TO SYMANTEC’S eLIBRARY BY YOU INDICATES YOUR AGREEMENT TO THESE TERMS.

IMPORTANT: The serial number provided with this Certificate is required to activate Your subscription and access to Symantec’s eLibrary. This Certificate entitles the registered user to access and use Symantec’s eLibrary through to the End Date printed on the face of this Certificate ("End Date"). In the event that the End Date is not identified on the face of this Certificate, the End Date will be deemed to be one (1) year from the Issue Date identified on the face of this Certificate. Please refer to the web site at http://www.symantec.com/en/uk/business/training/evoucher/index.jsp and follow the instructions provided to redeem your Certificate.

eLIBRARY SUBSCRIPTION: Your subscription fee entitles you to one (1) year of access to and use of Symantec’s eLibrary Subscription web site, expiring on the End Date. Your subscription to Symantec’s eLibrary is based on the subscription level and limited to the number of Users specified in the ‘Quantity’ section on the face of this Certificate. Single User subscriptions are limited to the designated User identified on the face of this Certificate and are non-transferable to any other individual. Subscription Levels identifying a range of Users (e.g. 2-10 or 11-25) will identify the specific number of Users receiving subscriptions in the ‘Quantity’ section on the face of this Certificate. The Enterprise Subscription Level designates an unlimited number of Users of the organization identified in the ‘Contract Owner’ section on the face of this Certificate who are located within the same country as the Contract Owner. For the purposes of this Certificate, the term “User” or “Users” as referenced herein shall mean an of the Contract Owner or contractor working on behalf of the Contract Owner who is bound by terms substantially similar to those contained herein. You are solely responsible for acquiring and maintaining the Internet or telecommunications services and devices required for employee User(s) to receive, access and/or use Symantec’s eLibrary. Symantec shall not be liable to You for your inability to access Symantec’s eLibrary or for any downtime of Symantec’s eLibrary due to reasonable scheduled maintenance, maintenance for critical issues or forces beyond the reasonable control of Symantec.

REPLACEMENT: Symantec is not responsible for a lost, expired, or invalid Certificate. In order to obtain a replacement Certificate, You must provide valid proof of purchase from either Symantec or the Symantec Authorized Reseller from whom you obtained the Certificate.

CANCELLATION; REFUND: You understand and agree no cancellation of the eLibrary subscriptions are permitted, and Symantec will not issue any refunds of fees paid for eLibrary subscriptions.

Any copying, dissemination, distribution or disclosure of Materials without the written authorization of Symantec is strictly prohibited. You may not use the Materials for any purpose other than for Your own education purposes and no additional license is implied. You may not copy, transfer, lease, assign, make available for timesharing or sublicense Symantec copyrighted Materials, in whole or in part, nor modify, reproduce nor distribute the Materials electronically or otherwise. INTEGRATION: This Certificate constitutes the entire agreement between the parties pertaining to the subject matter hereof, and supersedes any and all written or oral agreements with respect to such subject matter. It is expressly agreed that any pre-printed terms appearing on the face or reverse side of any purchase order, acknowledgement or confirmation issued by You that are different from or in addition to the terms provided in this Certificate are not binding on the parties, even if signed and returned by Symantec.

GOVERNING LAW: If You are located in North America or Latin America, this Certificate will be governed by the laws of the State of California, United States of America. If you are located in China, this Agreement will be governed by the laws of the Peoples Republic of China. Otherwise, this Agreement will be governed by the laws of England. Such governing laws are exclusive of any provisions of the United Nations Convention on Contracts for Sale of Goods, including any amendments thereto, and without regard to principles of conflicts of law.

Your Tech Center subscription (“Tech Center Subscription”) fee entitles You to a one (1) year access privilege to the Tech Center Subscription web site, after which your Tech Center Subscription automatically expires. Each year, thirty (30) days prior to expiration of your Tech Center Subscription, a renewal notification will be sent to Your registered email address. Each Tech Center Subscription is licensed for a single User and is not transferable to any other User.

All Symantec education training, and Symantec materials (including, without limitation, Symantec’s eLibrary and Tech Center Subscription web sites and Non Web Based Training Courses) and class materials, including supplemental information (collectively, the "Materials"), are the sole property of Symantec, protected by the Copyright Laws of the United States (Title 17, United States Code), and the laws of other countries where the Materials are made available. Any copying, dissemination, distribution or disclosure of Materials without the written authorization of Symantec is strictly prohibited. You may not use the Materials for any purpose other than for Your own education purposes and no additional license is implied. IN NO CASE SHALL SYMANTEC’S LIABILITY EXCEED THE PURCHASE PRICE PAID OR PAYABLE BY YOU FOR THE APPLICABLE NON WEB BASED TRAINING COURSE OR WEB BASED TRAINING COURSE.

These Terms and Conditions, in addition to the applicable Certificate governing Your applicable purchase of education course(s), constitutes the entire agreement between You and Symantec pertaining to the subject matter hereof, and supersedes any and all written or oral agreements with respect to such subject matter. It is expressly agreed that any pre-printed terms appearing on the face or reverse side of any purchase order, acknowledgement or confirmation issued by You that are different from or in addition to the terms provided in these Terms and Conditions and / or the Certificate are not binding on the parties, even if signed and returned by Symantec.

If You are located in North America or Latin America, these Terms and Conditions will be governed by the laws of the State of California, United States of America. If you are located in China, these Terms and Conditions will be governed by the laws of the Peoples Republic of China. Otherwise, these Terms and Conditions will be governed by the laws of England. Such governing laws are exclusive of any provisions of the United Nations Convention on Contracts for Sale of Goods, including any amendments thereto, and without regard to principles of conflicts of law.

You agree that You are not a citizen, national or resident of, and are not under the control of, the government of: Afghanistan, Cuba, Iran, Sudan, North Korea, Syria, nor any other country to which the United States has prohibited export and re-export. You will not download or otherwise export or re-export any Materials, directly or indirectly, to the above mentioned countries nor to citizens, nationals or residents of those countries. You are not listed on the United States Department of Treasury lists of Specially Designated Nationals, Specially Designated Terrorists, and Specially Designated Narcotic Traffickers, nor are You listed on the United States Department of Commerce Table of Denial Orders and / or any other federal agency of the United States or foreign government prohibited lists. You will not download or otherwise export or re-export any Materials directly or indirectly, to persons on the above mentioned lists. You will not use any Materials for, and will not allow any Materials to be used for, any purposes prohibited by United States and / or international trade laws, including, without limitation, for the development, design, manufacture or production of nuclear, chemical, missle, or biological weapons of mass destruction.

This Symantec Training Credits Program Certificate ("Certificate") is a legal agreement between the individual or organization ("You" or "Your") named on the face of this Certificate, and Symantec Corporation and/or its subsidiaries ("Symantec"). This Certificate states the terms and conditions under which Symantec training will be available to You and delivered to you upon registration for courses identified in Symantec’s then-current Training Credits Program Policy (each course, an "Eligible Course"). By ordering training, you acknowledge that such training is delivered subject to Symantec’s then-current Training Credits Program Policy.

IF YOU DO NOT AGREE TO THESE TERMS, THEN YOU ARE NOT ELIGIBLE TO RECEIVE TRAINING FROM SYMANTEC. ACCEPTANCE OF TRAINING INDICATES YOUR AGREEMENT TO THESE TERMS.

IMPORTANT: The serial number provided with this Certificate is required to register for Eligible Courses. This Certificate entitles You to a specific number of training credits ("Training Credits") which may be redeemed by You for Eligible Courses provided under one of the delivery models ("Delivery Models") identified below. Please refer to the web site at http://www.symantec.com/en/uk/business/training/evoucher/ and follow the instructions provided to redeem the Training Credits identified on the face of this Certificate. Training Credit values are calculated based on the currency in which they are purchased (“Purchasing Currency”) and, upon Your prior written request, may be redeemed to purchase a course offered in a different currency. If You request to redeem credits for a course offered in a different currency from Your Purchasing Currency, then Symantec will convert the Purchasing Currency to the currency associated with the redeemed course(s) using a fixed exchange rate based on the then current in-country list price of the courses and the corresponding credits will be deducted from Your account balance.

TRAINING CREDITS: The Training Credits must be redeemed for Eligible Courses that are registered and attended within twelve (12) months from the Issue Date identified on the face of this Certificate ("Term") and are non-transferable and non-refundable. Use of the Training Credits identified on the face of this Certificate are limited to You and, as applicable, Your individual employees or independent contractors while acting in such capacity. When registering for an Eligible Course, Your employee or contractor must identify himself/herself by providing Your Symantec Education Training Credits serial number. All Eligible Courses ordered, registered for, or attended on Your behalf will incur the appropriate reduction in Training Credits equal to the value of classes ordered for such employees / contractors, but not to exceed the total Training Credit balance available listed on the face of this Certificate.

You may use Training Credits to acquire Eligible Courses of equal or lesser value (as specified in Symantec’s then-current in-country standard education services catalog) than the number of unused Training Credits available under this Certificate. As Training Credits are redeemed, the Training Credits will be reduced from Your then remaining credit balance available. The Training Credits cannot be used as partial payment for any education services, e.g. if the applicable charge for an Eligible Course is greater than the unused Training Credits connected with this Certificate, such Training Credits may not be applied against such Eligible Course. You are responsible for all travel or out-of-pocket expenses incurred by your personnel in attending an Eligible Course or any other Symantec education courses.

TRAINING COURSES – DELIVERY OPTIONS: Symantec Education currently delivers its Eligible Courses offered under this Certificate utilizing four (4) different Delivery Models: 1) Open Enrollment, 2) Dedicated training, 3) Mobile training and 4) Onsite training. Open Enrollment offers training at an Authorized Symantec regional training center or via Internet based eLearning or virtual courses. Dedicated training is offered solely at Authorized Symantec regional training centers and entails courses dedicated solely to Your employees attending the course. Mobile training offers training at a site selected by You, with Symantec providing the necessary instructors, software, course materials, computers and connectivity for the course. Onsite training is offered by Symantec's instructors to Your employees at Your sites, using Your equipment and facilities. Virtual and eLearning courses may require Your agreement to additional terms and conditions, prior to, or at the time of receipt of such coursework. Please refer to the Training Credits Program Policy for regional Training Credit conversion rates and Eligible Course fees for each of the Delivery Models described above.

CLASS SIZE LIMITS/MINIMUM COURSE LENGTH REQUIREMENTS: Open Enrollment classes are limited by the size of the regional training facility and the ratio of instructors to students, and the class size limits for Open Enrollment courses cannot be modified on a class by class basis. Please refer to the Training Credits Program Policy for regional information regarding the maximum number of students permitted to participate in a Mobile, Dedicated or Onsite training course. For Mobile, Dedicated or Onsite training courses, if Your proposed class size exceeds the maximum number of student enrollees allowable for a course as stated in the Training Credits Program Policy, and if Symantec agrees to accommodate one or more additional students above the stated maximum class size for such course, then You will be invoiced an additional amount of Training Credits based on the fees identified in the current in country standard Education Services catalog, for each additional student enrolled for the training. Ordering such training will constitute Your acceptance to such additional Training Credit fees for such additional students. Please contact your Symantec training coordinator for additional details. All education courses, including Eligible Courses, and registration are subject to space availability.

CANCELLATION/RESCHEDULE POLICY: Use of Training Credits shall also be subject to the then-current in-country Symantec Education Cancellation/Reschedule policy. Refer to the Symantec Education Cancellation/Reschedule policy for further information.

TERMINATION OF TRAINING CREDITS PERIOD: At the end of the Term, any pre-paid, remaining unused Training Credits under this Certificate shall expire and shall be forfeited. No refunds shall be provided based on any remaining, pre-paid unused Training Credits. All Eligible Courses must be registered and attended during the Term; provided, however, if Symantec Education cancels and reschedules a class past the "expiration date" of the Term, you may use the applicable Training Credits for such class within ninety (90) days of 'expiration date' of the Term.

REPLACEMENT: Symantec is not responsible for a lost, expired, or invalid Certificate. In order to obtain a replacement Certificate, You must provide valid proof of purchase from either Symantec or the Symantec Authorized Reseller from whom you obtained the Certificate.

IN NO CASE SHALL SYMANTEC’S LIABILITY EXCEED THE PURCHASE PRICE SET FORTH ON THE FACE OF THIS CERTIFICATE.

This Symantec Training Bundle Certificate ("Certificate") is a legal agreement between the individual or organization ("You" or "Your") named on the face of this Certificate, and Symantec Corporation and/or its subsidiaries ("Symantec"). This Certificate states the terms and conditions applicable to the Symantec education services described below ("Education Services"). By accessing the Education Services and/or ordering training, you acknowledge and agree that Your access to and use of Symantec’s Education Services is subject to the terms contained in this Certificate and Symantec's then current Education Services terms and conditions and policies described herein.

IF YOU DO NOT AGREE TO THESE TERMS, THEN YOU ARE NOT ELIGIBLE TO ACCESS AND / OR USE SYMANTEC’S EDUCATION SERVICES. ACCESS TO ANY SYMANTEC EDUCATION SERVICES INCLUDED IN THE TRAINING BUNDLE INDICATES YOUR AGREEMENT TO THESE TERMS.

IMPORTANT: This Certificate entitles You and, as applicable, Your individual employees or independent contractors while acting in such capacity, to access and use the Education Services specified on the face of this Certificate during the period between the Start Date and End Date printed on the face of this Certificate ("Term"). In the event that the Education Services include Symantec training classes, such classes must be registered and attended during the Term. Registration for the Symantec training classes will automatically enable access to the other components purchased hereunder. In the event that Symantec has provided you with registration information prior to receipt of this Certificate, no further action is required. If you have not been previously notified then You must contact Your Symantec representative to register for your Symantec training classes. TRAINING (INSTRUCTOR-LED TRAINING AND VIRTUAL ACADEMY): This Certificate entitles a single representative of Yours to attend the Symantec instructor-led training class or Virtual Academy training class specified on the face of this Certificate during the Term. Each class attendee is required to accept Symantec Education’s Copyright and Compliance policies prior to the commencement of the training class. Refer to the Course Terms and Conditions to review these Symantec Education Copyright and Compliance policies. Use of Training shall also be subject to the then-current in-country Symantec Education Cancellation/Reschedule policy. Refer to the Symantec Education Cancellation/Reschedule policy for further information. All Symantec training classes and registration are subject to space availability.

VIDEO; VIDEO INSTRUCTOR-LED TRAINING: This Certificate entitles a single representative of Yours to access to an on-demand video version of the training class specified on the face of this Certificate during the Term, as such class is made generally available by Symantec. Note that if Your training class is not generally available on the Issue Date and is first made generally available during the Term, Your entitlement to such training class will still be limited to the Term specified on this Certificate. You are required to accept Symantec Education’s Copyright and Compliance policies before accessing Your Video Instructor-Led Training. Refer to the Course Terms and Conditions to review these Symantec Education Copyright and Compliance policies.

eLIBRARY: This Certificate entitles a single representative of Yours to a Single User subscription to access to and use of Symantec’s eLibrary Subscription web site during the Term. Your eLibrary subscription shall be governed by the Symantec eLibrary terms and conditions.

CERTIFICATION: Your Training Bundle purchase entitles you to take any single Symantec certification exam available during the Term. You will receive a separate Certification voucher ("Certification Voucher") from Symantec within fifteen (15) business days of the Issue Date printed on the face of this Certificate that You can redeem for a single Certification exam. Your Certification shall be governed by the Certification Program policies.

EXPIRATION OF TRAINING BUNDLE PERIOD: At the end of the Term, any pre-paid, remaining unused Education Services under this Certificate shall expire and shall be forfeited. No refunds shall be provided based on any remaining, pre-paid unused Education Services. All training classes must be registered and attended during the Term; provided, however, if Symantec Education cancels and reschedules a class past the "expiration date" of the Term, you may use the applicable Training for such class within ninety (90) days of 'expiration date' of the Term.

CANCELLATION; REFUND: You understand and agree no cancellation of Your Training Bundle(s) are permitted, and Symantec will not issue any refunds of fees paid for Training Bundle(s).

REPLACEMENT: Symantec is not responsible for a lost, expired, or invalid Certificate. In order to obtain a replacement Certificate, You must provide valid proof of purchase from either Symantec or the Symantec Authorized Reseller from whom you obtained the Certificate.

COPYRIGHT WARNING; RESTRICTIONS ON USE: All Symantec Education Services and class materials, including supplemental information (collectively, the "Materials"), are the sole property of Symantec, protected by the Copyright Laws of the United States (Title 17, United States Code), and the laws of other countries where the Materials are made available. Any copying, dissemination, distribution or disclosure of Materials without the written authorization of Symantec is strictly prohibited. You may not use the Materials for any purpose other than for Your own education purposes and no additional license is implied. SYMANTEC PROVIDES THE MATERIALS TO YOU "AS IS" AND TO THE FULLEST EXTENT PERMITTED BY LAW DISCLAIMS ANY IMPLIED WARRANTIES, CONDITIONS, TERMS, UNDERTAKINGS OR REPRESENTATIONS, INCLUDING WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW AND REGARDLESS OF WHETHER ANY REMEDY SET FORTH HEREIN FAILS OF ITS ESSENTIAL PURPOSE, IN NO EVENT WILL SYMANTEC BE LIABLE TO YOU FOR ANY SPECIAL, CONSEQUENTIAL, INDIRECT OR SIMILAR DAMAGES, INCLUDING ANY LOST PROFITS OR LOST OR CORRUPTION OF DATA ARISING OUT OF THE PROVISION OF TRAINING COURSES AND MATERIALS TO YOU EVEN IF SYMANTEC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO CASE SHALL SYMANTEC'S LIABILITY EXCEED THE PURCHASE PRICE SET FORTH ON THE FACE OF THIS CERTIFICATE.

INTEGRATION: This Certificate, including any terms and conditions referenced herein, constitutes the entire agreement between the parties pertaining to the subject matter hereof, and supersedes any and all written or oral agreements with respect to such subject matter. It is expressly agreed that any pre-printed terms appearing on the face or reverse side of any purchase order, acknowledgement or confirmation issued by You that are different from or in addition to the terms provided in this Certificate are not binding on the parties, even if signed and returned by Symantec. In the event of a conflict between this Certificate and any of the terms and conditions and policies applicable to the Education Services described above and located at the URLs identified above, the terms of this Certificate shall control.

GOVERNING LAW: If You are located in North America or Latin America, this Certificate will be governed by the laws of the State of California, United States of America. If you are located in China, this Agreement will be governed by the laws of the Peoples Republic of China. Otherwise, this Agreement will be governed by the laws of England. Such governing laws are exclusive of any provisions of the United Nations Convention on Contracts for Sale of Goods, including any amendments thereto, and without regard to principles of conflicts of law.
